Pink Hill Volunteer Fire Department is committed to operating the properties located at 203 S. Pine St, Pink Hill, NC (referred to herein as the Premises) and conducting a haunted trail, fundraisers and related programs and activities in a safe manner. As the property owners, PHVFD attempt to reduce risks and insists that all visitors and invitee follow safety rules and instructions while on the premises.

In spite of care and proper maintenance of the premises there is a risk of serious injury or bodily harm when visiting and participating in any indoor/outdoor recreational activity. Not all hazards and dangers can be foreseen. Participants understand that certain risks are involved in participating in indoor/outdoor activities at the premises. These risk include but are not limited to uneven and unpaved parking lots, indoor/outdoor uneven walking paths, sound effects, potentially slippery walking surfaces and the like. Further risks include, but are not limited to, slipping, falling, poor health conditioning of participants, careless horseplay and the like on the part of the participants. It is recognized and acknowledged by the undersigned participant that it is impossible for the owner of the premises to guarantee absolute safety. Rules and regulations of PHVFD must be followed at all times. Those rules and regulations are on the reverse side of this document.

I, the undersigned participant, hereby agree that by signing this document and visiting the premises, I expressly assume any and al risk and legal liability and waive, discharge, and release al claims against PHVFD and its owners, operators, agents and representatives for injuries (including death), damages, or loss which I, my minor child, members of my group, or our agents, might sustain as a result of participating in any and all activities connected with or associated with the premises.

As liquidated damages, I hereby agree that if PHVFD, its owners, operators, agents and/or representatives, are forced to defend any action, lawsuit, or litigation by myself, my executors, my heirs, successors or assigns, that Iagree to pay PHVFD, its owners, operators, agents and/or representatives the full costs and attorney fees if they successfully defend such action, lawsuit or litigation.

This agreement shall be binding upon the heirs, successors and assigns of the undersigned and shall be construed pursuant to the laws of the State of North Carolina.
